In efforts to enhance China’s legal framework against unfair competition and promote orderly and fair market competition, the 14th National People’s Congress Standing Committee recently reviewed the draft amendments to the “Anti-Unfair Competition Law of the People’s Republic of China” and published the proposed amendments, seeking public feedback.
On January 7, 2025, the Chinese National People's Congress website introduced four key highlights of the proposed amendments to the Anti-Unfair Competition Law. The revisions focus on addressing deficiencies in traditional unfair competition practices, streamlining complex provisions on new forms of online data misconduct, introducing regulations on “anti-involutionary competition (referring to common trend of excessive competitiveness in the Chinese market that results in overstress and burnout, compromising market balance and well-being),” and refining existing legal responsibilities.
These updates aim to propel the development of China’s digital economy, prevent the adverse effects of cutthroat price competition, and maintain fair market practices.
The deadline for submitting feedback is January 23, 2025. AFD China will continue to monitor developments in these regulations.
